That screening, the day before protests marking the 10th anniversary (which I covered here, here and here), was organized by the World Can’t Wait, the campaigners responsible for my visit, and was followed by a panel discussion in which I was delighted to be speaking alongside the attorney Tom Wilner — my colleague in the newly established “Close Guantánamo” campaign and website, with whom I had just taken part in a lunchtime event at the New America Foundation (also with Congressman Jim Moran and Col. Morris Davis) — and Darold Killmer and Mari Newman, attorneys from Denver whom I had asked to come along and speak about their clients, five Yemenis who are still held at Guantánamo.

Introducing the Q&A session, I spoke briefly about the “Close Guantánamo” campaign and the now-closed petition on the White House’s “We the People” website, asking President Obama to fulfil his promise to close Guantánamo, and also reminded those attending that, while criticizing Congress for inserting provisions in the National Defense Authorization Act (NDAA) demanding the mandatory military custody, without charge or trial, of anyone who can be accused of being associated with al-Qaeda, they should not forget that, for ten years, the prisoners in Guantánamo have been detained on essentially the same basis.

I also urged people to go away with just one message to tell everyone they meet — that, far from holding “the worst of the worst,” the Guantánamo of today actually contains 89 prisoners, out of the 171 still held, who have been cleared for release by the President’s interagency Task Force, but who are still held because they have become the victims of cynical political maneuvering.

After this introduction, I turned the mike over to Darold Killmer and Mari Newman, who spoke eloquently about their clients, the obstructions they have faced, and their incredulity that US justice has so spectacularly failed them. They also explained how their clients have persistently asked them to make sure that their stories are not forgotten, and anyone wishing to know more can read the stories of two of these men — Abdul Rahman al-Qyati and Musa’ab al-Madhwani — in the Center for Constitutional Rights’ “Faces of Guantánamo” reports that I played a major role in compiling, and which are also available here.

Afterwards, Tom also spoke, eloquently explaining his own disappointments, urging those attending to join the “Close Guantánamo” campaign, and also explaining, as he did last week in an article on the “Close Guantánamo” website, which I publicized here, that the NDAA actually contains a waiver, whereby the administration can, if it wishes, release prisoners from Guantánamo without having to overcome the almost insurmountable obstacles raised by Congress that have prevented a single prisoner from being released in the last 13 months.

Now, as Tom also mentioned, the only obstacle to the release of prisoners is whether President Obama and his administration can find the courage and the political will to actually follow through, and to begin to release some of those 89 cleared prisoners who are still held, but whose ongoing detention ought to be a source of shame.

This was the day before the rally and march to close Guantánamo, which I covered here, here and here, and it was an extremely well attended event, with over a hundred people in the audience — mostly campaigners from the various organizations involved in the January 11 protest, including Amnesty International, Witness Against Torture, the World Can’t Wait, Code Pink and the National Religious Campaign Against Torture.

Also present were: the attorney Tom Wilner — my colleague in the newly established “Close Guantánamo” campaign and website, with whom I had just taken part in a lunchtime event at the New America Foundation (also with Congressman Jim Moran and Col. Morris Davis) — and Darold Killmer and Mari Newman, attorneys from Denver whom I had asked to come along and speak about their clients, five Yemenis who are still held at Guantánamo.

The half-hour Q&A session that followed the screening was filmed, and I’ll be posting that soon, but first I’m posting below a short introduction I delivered while the staff at Busboys and Poets worked on technical issues involving the screening. While these were being resolved, I told the audience about the “Close Guantánamo” campaign, and our petition on the White House’s “We the People” website, asking President Obama to fulfil his promise to close Guantánamo. The petition has a one-month deadline, which comes to an end on February 6, so please sign it if you haven’t done so already.

I also told the audience about the news from Guantánamo, via Ramzi Kassem, the attorney for Shaker Aamer, the last British resident in Guantánamo, which I had announced on my website that day. Shaker and other prisoners had made it clear that they would be holding a three-day protest and hunger strike, to let the world know that they were not happy that President Obama was getting away with portraying Guantánamo as a safe and humane facility, and also to show solidarity with those protesting in Washington D.C. and elsewhere in the US.

In addition, I spoke specifically about the need to create a campaign on both sides of the Atlantic to push for the release of Shaker Aamer, well known as the foremost defender in Guantánamo of the prisoners’ human rights, on the basis that the Obama administration no longer wants to hold him, and the British government has asked for him to be returned to his wife and family in the UK.

I noted that the Congressional restrictions on releasing prisoners to countries that lawmakers regard as dangerous (included in provisions in the horrendous National Defense Authorization Act, in which lawmakers also declared their intention to hold terror suspects in permanent military custody, without charge or trial), could not realistically extend to the UK, making Shaker the prime candidate for breaking the deadlock regarding the release of prisoners from Guantánamo.

As I also explained, in 2011, the restrictions were so successful that only one living prisoner — an Algerian who had his habeas corpus petition granted by the courts — was released, and two others left in coffins, having died at the prison.

To mark the 10th anniversary of the opening of Guantánamo, on January 11, I was involved in two particular projects — firstly, the establishment of a new campaign and website, “Close Guantánamo,” designed to raise awareness of the continuing injustice of Guantánamo, and, in particular, the injustice of continuing to hold 89 of the remaining 171 prisoners, even though they have been cleared for release; and secondly, the establishment of a petition on the White House’s “We the People” website, calling on President Obama to fulfil his promise to close Guantánamo.

The “Close Guantánamo” project has only just begun, and will enter a new phase next week with the publication of the first of the profiles of the 171 prisoners still held, designed to inform people that they are human beings, with feelings, and with families, who, after ten years, are not held legitimately, but are, as Navi Pillay, the UN High Commissioner for Human Rights, explained last week, subjected to arbitrary detention.

In contrast, the second project — the petition on the White House’s “We the People” website — has just three days left until its deadline of one month is reached, so please, if you haven’t yet signed it, sign it now, and please also tell everyone you know. This could be the weekend that we beat the odds and come up with the signatures we need to secure a response from President Obama. The countdown clock, above, by the way, is from the Center for Constitutional Rights’ “Close Guantánamo” page, which also features videos from the protests in Washington D.C. on January 11 (and which I wrote about here).

Please note, crucially, that you do not have to be a US citizen or a US resident to sign the petition. When registering (which you must do first), just leave the box blank that asks you for your zip code.

Also, please note that some people have had problems with the site, which, unfortunately, are beyond the control of those setting up petitions. However, the following advice is from a friend who managed to overcome the obstacles:

A trick for getting the not-very-helpful website to work:

Having created an account, then persuaded it to accept your password (this can take a while), you’ll then find you’re on your profile page, miles away from the petition. In another tab, reclick the link to the petition.

If the “Sign Now” button is greyed out, make sure you’re logged in, then reload the petition page. Eventually you’ll get there, but they don’t make it easy.

They don’t indeed, and the problems with the site, to my mind, reflect badly on the Obama administration, which has also been beset with problems — like failing to keep important promises, such as the promise to close Guantánamo within a year, which the President made in an executive order on January 22, 2009.

My thanks to everyone who has worked to promote this petition, and to try to raise awareness of an ongoing disgrace that far too many people would rather forget. Guantánamo can be closed, and those of us who care — including those who signed up to the “Close Guantánamo” mission statement — will continue working hard to make that day a reality.

In her exact words, Navi Pillay said:

It is ten years since the US Government opened the prison at Guantánamo, and now three years since 22 January 2009, when the President ordered its closure within twelve months. Yet the facility continues to exist and individuals remain arbitrarily detained — indefinitely — in clear breach of international law.

I was encouraged by the mention of arbitrary detention, as I have been attempting, for over a year, to ascertain when it would be appropriate to describe the prisoners as being subjected to arbitrary detention, given that they remain held, whether or not they have been cleared for release. 89 of the remaining 171 prisoners were cleared for release at least two years ago by an interagency Task Force established by President Obama, but they remain held, because of hysteria regarding the security situation in Yemen, and because of Congressional obstruction. Now, perhaps, the UN Working Group on Arbitrary Detention will be able to exert pressure on the administration, by requesting a visit to the prison.

Navi Pillay also discussed the recently passed National Defense Authorization Act, with its disgraceful requirement for the mandatory military custody, without charge or trial, of anyone who can be described as having a connection to al-Qaeda. As she explained:

To make matters worse, the new National Defense Authorization Act, signed into law in December 2011, now effectively codifies such indefinite military detention without charge or trial. This piece of legislation contravenes some of the most fundamental tenets of justice and human rights, namely the right to a fair trial and the right not to be arbitrarily detained. Nobody should ever be held for years on end without being tried and convicted, or released.

The High Commissioner took note of President Obama’s commitment to interpret relevant sections of the National Defense Authorization Act “in a manner that ensures that any detention it authorizes complies with the Constitution, the laws of war, and all other applicable law,” which he noted when he signed the NDAA into law, but added:

While fully recognizing the right and duty of states to protect their people and territory from terrorist acts, I remind all branches of the US Government of their obligation under international human rights law to ensure that individuals deprived of their liberty can have the lawfulness of their detention reviewed before a court. Where credible evidence exists against Guantánamo detainees, they should be charged and prosecuted. Otherwise, they must be released.

Turning to accountability for torture, Navi Pillay explained that international law requires “thorough and systematic investigation of all allegations of serious human rights violations, including torture, that allegedly took place at Guantánamo Bay,” adding, “Every effort must be made to hold to account those responsible for the development, approval or implementation of coercive interrogation methods analogous to torture under international law. Individuals found to have perpetrated, ordered, tolerated or condoned torture and ill-treatment should be brought to justice.”

The High Commissioner also urged the Obama administration “to ensure that conditions of detention comply fully with human rights standards under international law,” explaining that “she was disturbed by the Government’s failure to allow independent human rights monitoring of the detention conditions at Guantánamo.” This is a long-standing complaint, and it highlights how Guantánamo remains a facility that, even under President Obama, is regarded, with complete justification, as an exception to the normal rules of detention.

In conclusion, she stated:

I urge the US Congress to take steps to enable the US Administration to close the Guantánamo Bay detention centre — as it stated it wished to do — in compliance with the Government’s obligations under international human rights law, and in so doing, to fully respect the principle of non-refoulement, under which no one should be sent back to a country where they may face torture.”

Ten years after Guantánamo opened, and three years after President Obama took office, it is depressing that the UN High Commissioner for Human Rights has to remind the US of its obligations, and to point out that the current situation is one in which the prisoners are held in arbitrary detention. I wish I could say that Congress and the Obama administration will be shamed into doing something about, but unfortunately it is unclear that anyone regards it as a pressing enough shame to take steps to bring the prison’s existence to an end once and for all.

Note: Please visit the website of the “Close Guantánamo” campaign, and sign up to join a growing body of people demanding that President Obama fulfill his unfulfilled promise to close the prison. Please also sign a new White House petition on the “We the People” website calling for the closure of Guantánamo. 25,000 signatures are needed by February 6 to secure a response from the President.

In the long struggle to close Guantánamo, protests took place in Washington D.C. and across America on the 10th anniversary of the opening of the prison on January 11, and the newly established “Close Guantánamo” campaign (of which I am a member of the steering committee) launched a petition on the White House’s “We the People” website, calling on President Obama to fulfill his promise to close the prison, which he made when he took office three years ago, and pointing out how fundamentally unjust it is that 89 of the remaining 171 prisoners have been cleared for release, and yet are still held.

That petition needs to secure 25,000 signatures by February 6, to oblige the President to respond, and at the time of writing, over 4,300 people had signed it. Many groups have been asking their supporters to sign it, and yesterday the Center for Constitutional Rights publicly added their voice to the campaign, sending out an email alert to all their supporters, asking them to sign the petition, and also asking visitors to the “Close Guantánamo” page on their website to sign it.

The embedded clock above was also created by CCR, and, in further publicity, three videos featuring speeches made outside the Supreme Court on January 11 — by Andy Worthington, by conscientious objector Daniel Lakemacher, who worked as a guard at Guantánamo, and by CCR’s executive director Vince Warren — have also been made available on CCR’s “Close Guantánamo” page, and are posted below.

I’d like to thank CCR for their support, and, in conclusion, if you haven’t yet signed the petition, please do so, and please also forward it to ten of your friends and family members. Time is running out, and we need 2,000 signatures a day for the next ten days to show that we care about the closure of Guantánamo, and that we are not prepared to put up with any more excuses from the administration or from members of Congress.

At the time, seven Tunisians had left Guantánamo, to face a variety of fates. Two had been repatriated in 2007, although both had then been imprisoned following show trials, two others were in Italy, where they had been delivered from Guantánamo to face trials in November 2009, and three others had been resettled in early 2010 in three other countries — namely, Slovakia, Albania and Georgia.

Soon after the fall of Ben Ali, the interim Tunisian government announced an amnesty for all political prisoners, paving the way for the return of exiled members of the Islamist party Ennahdha, and also the release of 55-year old Abdallah Hajji (also identified as Abdullah bin Amor), the former Guantánamo prisoner who was still imprisoned after a show trial. It also transpired that the other returned and imprisoned ex-Guantánamo prisoner, Lotfi Lagha, had actually been freed under President Ben Ali in June 2010.

Around the same time, one of the Tunisians sent to Italy, Mohammed Tahir Riyadh Nasseri, was convicted of criminal association with the aim of terrorism and sentenced to six years in prison, which seems harsh, especially as, just days later, on February 7, another judge delivered a completely different ruling in the case of Adel Ben Mabrouk (also identified as Adel Ben Mabrouk Bin Hamida Boughanmi), the other Tunisian sent to Italy from Guantánamo in November 2009. Although he too was convicted of criminal association with the aim of terrorism, the judge gave him a two-year suspended sentence and ordered his immediate release from jail, after taking into account “the eight years Mabrouk spent in Guantánamo in ‘inhumane conditions,’ plus a year and a half in Italian prison,” as his lawyer described it, even though he did not, at that point, have a passport or any kind of travel or identity papers.

On April 20, he returned to Tunisia, and after his return an Italian journalist traveled to Tunis to interview him, as I reported here.

On the third anniversary of President Obama’s failed promise to close Guantánamo, and the first anniversary of the fall of President Ben Ali, another Tunisian who returned home — Rafiq al-Hami, also identified as Rafik Hammi and Rafik al-Hammi — who had been released in Slovakia in January 2010, and had returned to his home country last March, appeared in a report on Guantánamo’s Tunisians on Al-Jazeera, and also in a longer video on the Guardian‘s website, both of which are posted below.

Al-Hami had spoken at a press conference in October last year, called by the interim government to campaign for the release of the remaining Guantánamo prisoners, when he said, “The years I spent in detention were unimaginable. I never knew if I would be able to return to my family and my homeland, and I was never informed of why I was being held, or given a chance to defend myself at trial. Since my return to Tunisia, I have finally been reunited with my family and have been able to experience normal life again. I have very high hopes for my future here.”

However, I had never seen what he looked like until these films were released. A quiet, bookish man with an almost secret smile that his long years of torture could not erase, he was clearly never a threat to anyone, and it is salutary to recall that he was actually brutalized not only in Guantánamo, but also in three “black sites” run by the CIA, where, as he explained in a lawsuit 2009, “his presence and his existence were unknown to everyone except his United States detainers,” and, at various times, he was “stripped naked, threatened with dogs, shackled in painful stress positions for hours, punched, kicked and exposed to extremes of heat and cold.”

Many years before, he had told his tribunal in Guantánamo that he was tortured for three months in the “Dark Prison” in Afghanistan, where, he said, “I was threatened. I was left out all night in the cold … I spent two months with no water, no shoes, in darkness and in the cold. There was darkness and loud music for two months. I was not allowed to pray … These things are documented. You have them.”

In the two and a half minute feature on Al-Jazeera, al-Hami spoke briefly about his experiences, and the report also noted the story of Adel Hakeemy, still held in Guantánamo, who was “accused of training al-Qaeda members, but all charges against him were dropped last year,” as Al-Jazeera explained. His brother Imad also spoke, as did Polly Rossdale of Reprieve, the legal action charity whose lawyers represent most of the Tunisians at Guantánamo.

In the seven minute video for the Guardian, in which Rafiq al-Hami spoke about his abuse, Adel Hakeemy’s brother appeared again, as did his mother. Most poignantly, his brother showed a photo of the daughter he has never met. Also included were the sister and mother of Hisham Sliti, also still held, and Cortney Busch of Reprieve was on hand to provide a good explanation of the circumstances surrounding the men’s ongoing detention, and the need for pressure to secure their release.

Ten years after Guantánamo opened, it is sad to see these stories of men still held, even though they were cleared for release by military review boards under President Bush, and even though the reason they fled Tunisia in the first place — because of their opposition to, and persecution by President Ben Ali — has come to an end, and they could be safely repatriated without any problems.

The first report, “Faces of Guantánamo: Resettlement,” focuses on the 89 prisoners still held who were cleared for release by President Obama’s Guantánamo Review Task Force, but who are still held either because they cannot be safely repatriated, and no country has volunteered to offer them a new home, or because they are Yemenis, and both the President and Congress have acted to prevent the release of any cleared Yemeni prisoners, even though this constitutes guilt by nationality, which is an indefensible generalization, and ought to be regarded as a profound shame.

The article explains in detail President Obama’s failures, including his refusal to allow any innocent prisoners (the Uighurs, Muslims from China’s Xinjiang province) to be settled in the US, and also describes how Congress has intervened to prevent the release of prisoners for nakedly political reasons. Included are recommendations for the Obama administration, and calls for other countries to help with the resettlement of those who cannot be safely repatriated.

There are also profiles of the following prisoners in need of new homes: Ahmed Ajam (a Syrian), Djamel Ameziane (an Algerian), Ahmed Belbacha (another Algerian), Ali Hussein al-Shaaban (another Syrian), Mohammed Tahamuttan (a Palestinian), Ravil Mingazov (a Russian), and Umar Abdulayev (a Tajik).

The second report, “Faces of Guantánamo: Indefinite Detention,” condemns President Obama for his decision to endorse indefinite detention without charge or trial for 46 of the remaining prisoners, on the spurious basis that they are too dangerous to release, even though there is insufficient evidence for them to be put on trial. As the report notes, “accepting indefinite detention crosses America over a dangerous Rubicon: permitting government officials to predict an individual’s future dangerousness through secret, untestable and potentially illegitimate criteria is incompatible with the most elementary principles permeating this country’s constitutional tradition.”

This second report also focuses on the unacceptable interference by the judges of the D.C. Circuit Court, who have been responsible for gutting habeas corpus of all meaning when it comes to the Guantánamo prisoners, by whittling away, for purely ideological reasons, at the detention standards agreed by the lower court judges making reasoned decisions about the prisoners’ habeas corpus petitions.

Also included is further criticism of Congress and, in particular, the provisions included in the National Defense Authorization Act, making it mandatory for terror suspects to be held in military custody without charge or trial, and also reiterating the restrictions on the release of Guantánamo prisoners that have actually been a feature of Congressional legislation for the last year, and have been largely responsible for the fact that no living prisoner has been released from Guantánamo since January 2011.

The report also features profiles of the following prisoners: Adnan Farhan Abdul Latif, Abdul Rahman al-Qyati, Ghaleb al-Bihani, Mohammed al-Adahi, Musa’ab al-Madhwani and Saeed Hatim (all Yemenis).

The third report, “Faces of Guantánamo: Torture,” examines how President Bush came to bypass the UN Convention Against Torture, and the US torture statute, even though the UN Convention, ratified by the US in 1987, explicitly states, “No exceptional circumstances whatsoever, whether a state of war, or a threat of war, internal political instability or any other public emergency, may be invoked as a justification for torture.”

The article covers the notorious military order of November 2001, establishing the military commissions, the internal memos dealing with the Geneva Conventions, which led to President Bush depriving the prisoners in his “war on terror” of the protections of the Geneva Conventions, including Common Article 3, which protects prisoners from torture or ill-treatment, and the subsequent establishment of an official torture program, with a justification provided by lawyers, close to former Vice President Dick Cheney, who cynically attempted to redefine torture.

The article also examines how former defense secretary Donald Rumsfeld introduced torture at Guantánamo, and how the open-ended detention to which those still held are subjected is itself a form of torture.

Also included are profiles of the following prisoners: Abu Zubaydah — and other “high-value detainees,” Ahmed al-Darbi (a Saudi), Mohamedou Ould Slahi (a Mauritanian), Mohammed al-Qahtani (another Saudi), Sanad al-Kazimi (a Yemeni), Shaker Aamer (the last British resident in Guantánamo) and Sharqawi Ali al-Hajj (another Yemeni).

In the first video, Ed asked me about how I became interested in exposing the injustices of Guantánamo and I explained how I became the custodian of the prisoners’ stories, and he also filmed my brief speech to the crowd, as well as the speeches made by the Guantánamo attorney Tom Wilner (my colleague in the newly-launched “Close Guantánamo” campaign), Vince Warren, the executive director of the Center of Constitutional Rights, Stephen Olesky, the attorney for Belkacem Bensayah, an Algerian still held in Guantánamo, and a very powerful speech by Daniel Lakemacher, a former Guantánamo guard and conscientious objector, who was noticeably moved by the presence of other people who care about the ongoing injustice of Guantánamo, and the continuing dehumanization of the men still held there.

In the second video, Ed captured part of the rally outside the White House, and the march to the Supreme Court, via the Justice Department, as well as the speech made outside the Supreme Court by Debra Sweet, the director of The World Can’t Wait, and the facilitator of my visit. The third video features the very moving recitation, by Leili Kashani of the Center for Constitutional Rights, of “Is It True?” written during his detention by a former Guantánamo prisoner, the Jordanian national Usama Abu Kabir, which the crowd echoed using the “call and response” method of transmitting information, which has been a hallmark of the Occupy movement, and was a very powerful experience, which I was delighted to find that Ed had filmed.

The screening has been arranged by Jean Lambert (UK Green MEP), with the support of Sarah Ludford (UK Liberal Democrat MEP) and Ana Gomes (Portuguese Socialist MEP), and the purpose of the screening is to raise awareness of the continued existence of Guantánamo, and its mockery of universal notions of fairness and justice, ten years after the prison opened, on January 11, 2002. Given President Obama’s very public failure to close the prison as promised, it is essential that other countries step forward to take cleared prisoners who cannot be safely repatriated, and one of the main purposes of the screening and the visit of Moazzam Begg and Andy Worthington is to encourage EU countries to re-engage with the process of resettling prisoners that was so successful in 2009 and 2010.

The screening is free, but anyone who wishes to attend needs to contact Rachel Sheppard, the Parliamentary Assistant to Jean Lambert MEP. If those wishing to attend do not already have an access badge for the European Parliament, they need to provide their full name, date of birth, nationality, passport number or ID card and number and also specify the type of document (passport, ID card) so that access badges can be arranged. Without an access badge, those wishing to attend the screening will not be allowed.

Moazzam Begg and Andy Worthington will be available to talk to the press along with Jean Lambert MP, Sarah Ludford MEP and Ana Gomes MEP. Moazzam and Andy will be available before the screening (between 4 pm and 6.30 pm) and afterwards (after 9 pm), and also on Wednesday morning, and, as mentioned above, they are hoping to have the opportunity discuss the need for European countries to revisit the generosity shown in 2009 and 2010, when many offered new homes to cleared Guantánamo prisoners who could not be safely repatriated.

171 prisoners are still held in Guantánamo, and 89 of these have been cleared for release by President Obama’s interagency Guantánamo Review Task Force. 58 of these men are Yemenis, whose release is being prevented by President Obama, and by Congress, but others remain in need of new homes, and it is only the absence of offers from, for example, countries in Europe, that is preventing them from finally being freed.

As Guantánamo recently marked the 10th anniversary of its opening, with no sign of when, if ever it will close, given Congressional opposition, and the President’s refusal, or inability to assert his authority, it would be a powerful humanitarian gesture if European countries once more agreed to take cleared prisoners, to help to close this shameful icon of the Bush administration’s misguided “war on terror.”

Moazzam Begg is the director of the NGO Cageprisoners, and the author, with Victoria Brittain, of the book Enemy Combatant. He was held in US custody in Afghanistan and in Guantánamo from January 2002 until March 2005, when he was released without charge or trial.

Andy Worthington is a freelance investigative journalist, the author of The Guantánamo Files, and the co-director of “Outside the Law: Stories from Guantánamo.” He is well-known as a world authority on Guantánamo. His website is AndyWorthington.co.uk, and he is also on the steering committee of the newly launched campaigning website, “Close Guantánamo.”

Polly Nash is a senior lecturer at the London College of Communication, University of the Arts, London, and the co-director of “Outside the Law: Stories from Guantánamo.”

“Outside the Law: Stories from Guantánamo” is a documentary film, directed by Polly Nash and Andy Worthington, telling the story of Guantánamo (and including sections on extraordinary rendition and secret prisons) with a particular focus on how the Bush administration turned its back on domestic and international laws, how prisoners were rounded up in Afghanistan and Pakistan without adequate screening (and often for bounty payments), and why some of these men may have been in Afghanistan or Pakistan for reasons unconnected with militancy or terrorism (as missionaries or humanitarian aid workers, for example).

The film is based around interviews with former prisoners (Moazzam Begg and, in his first major interview, Omar Deghayes, who was released in December 2007), lawyers for the prisoners (Clive Stafford Smith in the UK and Tom Wilner in the US), and journalist and author Andy Worthington, and also includes appearances from Guantánamo’s former Muslim chaplain James Yee, Shakeel Begg, a London-based Imam, and the British human rights lawyer Gareth Peirce.

Focusing on the stories of three particular prisoners – Shaker Aamer (who is still held, despite being cleared for release), Binyam Mohamed (who was released in February 2009) and Omar Deghayes — “Outside the Law: Stories from Guantánamo” provides a powerful rebuke to those who believe that Guantánamo holds “the worst of the worst” and that the Bush administration was justified in responding to the terrorist attacks of September 11, 2001 by holding men neither as prisoners of war, protected by the Geneva Conventions, nor as criminal suspects with habeas corpus rights, but as “illegal enemy combatants” with no rights whatsoever.
