While your contention regarding the first amendment and its relationship to this case may have merit, Col. Davis has not always (even within this past year) been a champion of free speech, or as you say the “soul of discretion regarding his former role as the Chief Prosecutor of the Commissions” he went so far as to blatantly bully colleagues to censor and suppress views not to his liking….see:

Unbelievable. “Feckless” as an adjective to describe Congress (and its Research Service) would seem to be an insult… to feckless people.

I have little doubt that Col. Davis will be vindicated one way or another– whether more intelligent heads prevail and reverse this stupid decision, or whether it takes a law suit.
