		<description>Unlike the United States, Italy is ultimately subject to the European Court of Human RIghts in Strasbourg; if Italy treats these men fairly and in accordance with applicable human rights laws, so be it; if it does not...  Strasbourg will ultimately decide  this (albeit some years from now).  

That the men may not get &quot;fair&quot; trials in  Italy is troubling, but is in no sense assured-- Italy has a relatively transparent  justice system, and by and large its prosecutors enjoy some measure of independence from political pressures compared to other places.

Still, the inability of the United States to even charge them with wrongdoing while issuing the rhetoric of &quot;worst of the worst&quot; is most troubling of all, and the Kafkaesque nightmare that is America&#039;s legal black hole will at least end for these men, even if something else troubling has arisen in its stead.  The Obama Administration&#039;s record of trickling out perhaps 1 or 1 1/2% of the prisoners left per month means that GTMO will not be closed by 22 January 2010... or for that matter by 22 January 2017.</description>
