		<description>We&#039;re back to having a government that apparently genuinely fears that due process of law will actually result in outcomes that are not preordained (notwithstanding the damned near 100% conviction rate for terrorism cases in federal courts, and notwithstanding that two out of three military commissions ended up handing out far shorter sentences than the government wanted).  Slow learners, I guess.    

Good work on the math by Andy, though I tend to think that the number proposed as subject to trial of 60 or so is absurdly high... by a factor, of say, 40, or 42 which, in my view, is much more likely to get us to the 90 or so who &quot;are too dangerous to be tried but can&#039;t be released&quot; nonsense (rather than the Yemenis, who I think they really do want to send somewhere... anywhere except our sacred homeland).

There are countries that have such categories of people &quot;too dangerous to release but who can&#039;t be tried&quot; in their custody: we rightfully call such countries &quot;dictatorships.&quot;  There is no such category recognized by our law: men can either be held as prisoners of war, or they can be held as charged criminal suspects, or they can be released, period.

Of course, Obama is showing the same kind of courage on these issues that he seems to be showing on giving away the so-called &quot;public option&quot; in &quot;health care reform&quot;, or in giving away the stimulus part of the &quot;stimulus bill&quot;...
