[...] The Bush Administration maintains that the Bagram detainees are enemy combatants and the United States can detain them indefinitely, without charge or access to lawyers, until the end of hostilities, whenever that may be. The Supreme Court has rejected this argument repeatedly in connection with Guantanamo detainees. (See SCOTUSblog for a description of the hearing and see Andy Worthington, Seven Years Of Guantánamo, And A Call For Justice At Bagram). [...]

I worked as a legislative aide in the U.S. House of Reps Committee on Education and Labor during the Carter to Reagan transition. As I recall it, the first program under the Committee's purview that David Stockman came to eviscerate was the WIC (Women, Infants and Children) program--a nutritional program for infants and their nursing mothers. From a budgetary perspective, gouging WIC was immaterial. But as a symbol of the merciless power they intended to wield, it was a mighty blow. If the new Republican administration could do that--literally take food out of the mouths of newborns--they could do anything. And so it was and here we are.

Conversely, closing Guantanamo, razing the facility, and most importantly, caring for the victims (who have been as helpless as infants to defend against the vicious force brought to bear on their minds, bodies and souls), is a potent symbol of hope and positive transformation. Success at our efforts in Cuba will help as we address the conditions of detainees at the Bagram facility, as well as for tens of thousands of prisoners rotting in similar U.S. run hellholes in Iraq.

The struggle for justice is epic and ongoing. What else is new?
