I have recently become the 'victim' of the English judicial system.
I prosecuted a case against a Local Authority and signed a Consent Contract withdrawing a substantial Claim in 2002.
When they failed to perform the Consent Contract I had to sue for damages.
At the very first Case Management Conference the Defendant, through its Legal Counsel told the Master that the agreed repair works to my premises had been 'done' 'Finished' ' 'completed'.
In fact three years later in 2005 by accident it was revealed that the Defendant, within days after inducing me to sign the contract, unilaterally extracted vital repair works from the agreed works, without my knowledge or agreement which affected my insurance status for six years. It was a sheer impossibility, once they had extracted those works, that the contract could EVER have been performed.
My contention is that by 'lying' to the Master in 2003and concealing the aleration they had made to the contract the proceedings were fundamentally flawed, the proceedings dragged on for a further three years and in the end I have ended up having to pay the 'D' costs since the damages awarded to me did not meet a Part 36 offer they had made to me.
Can I prosecute the Defendant for perjury?
